When a person unlawfully uses another individual's personal identification as a means to commit fraud, he or she has committed identity theft. This common type of fraud is used in the U.S., and throughout the world, as a means to illegally obtain money. Forms of identification that are commonly used or stolen to commit identity fraud are a person's name, credit card number, birth date, Social Security number, bank account number, and driver's license.

Various laws and acts have been added to prevent identity theft and to ensure that defendants found guilty of identity theft are harshly punished. The Identity Theft and Assumption Deterrence Act of 1998 was enacted to make identity theft a Federal offense within the United States. Therefore, anyone who is accused of identity theft will be prosecuted under Federal law. In certain circumstances, a person who is found guilty of identity theft may be sentenced to up to 25 years in prison.

The following are a few examples of identity theft:

  • Defrauding the U.S. by obtaining and using fraudulent identification
  • Deliberately possessing a stolen form of identification
  • Using another individual's identification in an attempt to commit a felony
  • Deliberately and illegally possessing false identification
  • Using another individual's identification when violating a Federal law

As the result of the ongoing problem of identity theft, thorough investigations are being conducted of all suspected felony cases of identity theft in Southern California. Suspects are being strictly prosecuted by law enforcement agencies and the judicial system.
