Thorough Practice

Under the Uniform Code of Military Justice (UCMJ), all men and women serving in the United States Armed Forces are subject to military law - as opposed to civilian courts. Ultimately, this means either the military or the federal government will be conducting the proceedings, both of which are stocked with any number of prosecutors and legal teams. But with the proper counsel, not one appointed to you, it is more than possible to achieve the optimal outcome. The Law Firm of Joseph H. Low IV has extensive experience in a wide spectrum of military matters including, but not limited to:

  • Defense of General, Special and Summary Courts-Martial
  • Article 32 Hearings
  • Appeals of Convictions by Courts-Martial before the service Court of Criminal Appeals, the Court of Appeals for the Armed Forces, and the Supreme Court
  • Representation and Advisement in Article 21, UCMJ, Investigations
  • Representation and Advisement in Criminal Suspect Investigations
  • Representation and Advisement in Non-Judicial Punishment Under Article 15
  • Representation and Advisement in Administrative Discharge Boards
  • Military pay and personnel cases before the U.S. Court of Federal Claims

Courts-Martial Survival Tips

If you have been detained and are accused of a crime, adhere to the following guidelines!

  • Talk only to your lawyer.
  • You have an absolute right to remain silent. Use it always. Talking to investigators or your superiors will generally NOT help your case. It may, however, help convict you.
    • Article 31 of the UCMJ (10 U.S.C. § 831) provides that: No person subject to this chapter may interrogate, or request any statement from, an accused or a person suspected of an offense without first informing him of the nature of the accusation and advising him that he does not have to make any statement regarding the offense of which he is accused or suspected, and that any statement made by him may be used as evidence against him in a trial by court-martial.
  • Watch out for government investigators trying to "help" you. Remember, they are paid to convict you, not to help you, and they may lie to you in order to get you to give them information.
