In August of 2017, Tomasa Cuevas was driving to the store with her two of her children, Alex and Maritza, when their SUV was struck by a big-rig – owned by Rai Transport’s – that had run a red light.

The accident caused severe injuries to each member of the Cuevas family: Tomasa’s injuries included skull and facial fractures, a brain bleed, and vision damage as a result of torn olfactory nerves; Alex, a high school cross country runner, suffered a brain bleed, dislocated hip, and skull and facial fractures; and Maritza was diagnosed with post-traumatic stress disorder in addition to scratches sustained in the crash.

Attorney Joseph H. Low IV worked alongside Rodriguez & Associates to achieve justice for their clients and ensure the trucking company properly compensated their clients for the damages inflicted upon them. During the trial, the attorneys argued in Kern County Superior Court that the driver should not have been behind the wheel of the big rig at the time of the accident because his license was suspended as a result of being involved in over a dozen accidents prior to this event.

Though the defense denied this contention, over the course of 12 days the combined efforts of the Law Firm of Joseph H. Low IV and Rodriguez & Associates were able to convince the jury that the accident was completely avoidable.

The Cuevas family was awarded $70,500,000 in damages related to the accidents, giving them the opportunity to recover from this tragic event. The Law Firm of Joseph H. Low IV was proud to work with Rodriguez & Associates to ensure justice was upheld for their clients.
