California Penal Code 207a states that: "Every person who forcibly, or by any other means of instilling fear, steals or takes, or holds, detains, or arrests any person in this state, and carries the person into another country, state, or county, or into another part of the same county, is guilty of kidnapping."

If you have been charged with kidnapping or attempted kidnapping, you are facing severe legal repercussions, as all kidnapping charges are classified as felonies. In addition to legal consequences, you may face problems within your community, your job, and other aspects of your personal life. Kidnapping is a very serious crime that is prosecuted harshly by the legal system. There is a possibility that you may have to register as a sex offender if you are convicted of kidnapping under special circumstances.

The typical sentence for a kidnapping conviction is a prison term of three to eight years, but depending upon the circumstances the sentence may be increased. For example, if the kidnapping victim is under the age of fourteen the prison sentence may be as long as eleven years. Other kidnapping crimes that carry with them extended sentences include kidnapping for ransom, kidnapping for extortion, and kidnapping that takes place during a carjacking.

The most severe sentence is explained in California Penal Code 209 b, which states: "Any person who kidnaps or carries away any individual to commit robbery, rape, spousal rape, oral copulation, sodomy, or sexual penetration in violation of Section 289, shall be punished by imprisonment in the state prison for life with possibility of parole."
